Agreement And Electronic Acceptance
These Terms apply to services purchased from Jason Fung Studio. By checking the agreement box and continuing to checkout, the client accepts these Terms, the selected services, and the weekly price displayed before checkout. The client should save or print a copy for their records.
Services
Services are limited to the items selected before checkout and the priorities agreed during onboarding or later in writing. Weekly support provides reasonable hands-on capacity for those priorities; it is not unlimited work, guaranteed hours, or a promise that every request will be completed within one billing week.
Service Delivery And Fulfillment
Jason Fung Studio provides digital marketing and ecommerce services rather than physical goods. Work begins on the start date agreed after onboarding and after required access, assets, information, and approvals are available. Deliverables and ongoing work are provided electronically through the client’s accounts, shared files, email, or other agreed systems. Timing depends on the agreed scope and the client responsibilities described below.
30-Day Execution Guarantee
When a written first-30-day scope is identified as covered by the 30-Day Execution Guarantee, Jason Fung Studio will complete that agreed scope or continue working on the incomplete covered items at no additional service fee until they are completed. The guarantee does not expand the agreed scope and does not apply to delays caused by missing or late access, assets, inventory, information, feedback, approvals, third-party outages, platform restrictions, or other circumstances outside Jason Fung Studio’s reasonable control. Revenue, sales, return on ad spend, and other performance outcomes are not guaranteed.
Weekly Billing And Payment
The exact recurring weekly price is the total displayed immediately before checkout. When checkout includes a seven-day free trial, Stripe collects the client’s payment method but charges no service fee when the trial begins. Unless the client cancels before the trial ends, Stripe automatically charges the displayed weekly price after seven days and weekly afterward until cancellation. The client authorizes these recurring charges to the payment method provided. Taxes, if applicable, may be added. A failed or disputed payment may pause work and access to services.
Cancellation And Refunds
The client may cancel at any time by emailing jasonfungstudio@gmail.com. Cancellation received before the seven-day free trial ends prevents the first recurring service charge and ends access to the service. After billing begins, cancellation takes effect when written notice is received: no new weekly charge will be initiated after receipt, but a charge already processed is not automatically reversed. Work continues through the paid billing period unless the client asks it to stop sooner. Payments for a billing period in which work has begun are non-refundable except where required by law.
Scope And Price Changes
Additional services, larger standalone projects, or work beyond the selected scope may change pricing only after the client agrees to the new scope and price. Removing a service changes future billing after the change is confirmed. Performance-based pricing applies only under a separate written agreement that defines the calculation, reporting source, payment timing, and other applicable terms.
Advertising And Third-Party Costs
Advertising spend, Shopify fees, apps, domains, software, stock assets, production, and other third-party costs are paid separately by the client unless explicitly included in writing. The client remains responsible for third-party platform accounts, policies, charges, and decisions.
Client Responsibilities
Clients are responsible for providing accurate information, assets, feedback, approvals, account access, and project information on time. The client confirms they have authority to provide all supplied materials and access. Timelines and results may be affected when information, access, inventory, assets, feedback, or approvals are delayed.
Revisions
Projects include the revision rounds agreed in the proposal or scope of work. Additional revisions or expanded requests may require a separate estimate.
No Revenue Guarantee
Jason Fung Studio does not guarantee revenue, return on ad spend, sales volume, or conversion improvements. Services focus on improving the Shopify experience, campaign connection, customer clarity, and operating foundation.
Intellectual Property
Final approved project deliverables transfer to the client after final payment, unless otherwise agreed. Jason Fung Studio may retain rights to process, tools, templates, and pre-existing materials.
Confidentiality And Account Access
Each party will use reasonable care to protect non-public business information received through the engagement. The client should grant only the access required for the work. When services end, Jason Fung Studio will stop active work and remove or return its access where practical; the client remains responsible for revoking permissions and changing credentials. Paid deliverables already provided remain available to the client.
Limitation Of Liability
To the extent permitted by law, Jason Fung Studio is not liable for indirect, incidental, special, or consequential damages related to the website, services, third-party platforms, or business results. Total liability arising from a weekly service engagement will not exceed the fees paid for that engagement during the four weeks immediately before the event giving rise to the claim.
